1. Acceptance of Terms

By downloading, installing, or using the EmanPal mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

        Agreement: These Terms constitute a legally binding agreement between you and EmanPal. By using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
    

2. Description of Service

EmanPal provides Islamic spiritual services including but not limited to:

Prayer time calculations and notifications (Athan)
Quran reading with translations and audio recitations
Qibla direction finder
Islamic Hijri calendar
Daily duas, adhkar, and supplications
Islamic educational content

3. User Eligibility

The App is available to users of all ages. However:

Users under the age of 13 should use the App under parental supervision.
By using the App, you represent that you have the legal capacity to enter into these Terms.
If you are using the App on behalf of a minor, you agree to these Terms on their behalf.

4. User Accounts

4.1 Account Creation

Some features may require you to create an account. When creating an account, you agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

4.2 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use the App for any illegal or unauthorized purpose
Attempt to reverse engineer, decompile, or disassemble the App
Interfere with or disrupt the App's servers or networks
Use automated systems to access the App without permission
Collect or harvest user data without authorization
Upload malicious code or content
Impersonate others or misrepresent your affiliation

6. Intellectual Property

6.1 Our Content

The App, including its design, features, content, and functionality, is owned by EmanPal and protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or distribute our proprietary content
Use our trademarks without written permission
Create derivative works based on our App

6.2 Quranic Content

The Quran text and translations are provided for personal, non-commercial use. Audio recitations are licensed from their respective reciters and copyright holders.

6.3 User Content

Any content you create within the App (bookmarks, notes, etc.) remains your property. By using the App, you grant us a limited license to store and display this content to you.

7. Prayer Times Disclaimer

Important: Prayer times provided by EmanPal are calculated based on astronomical algorithms and your location data. While we strive for accuracy, these times are estimates and may vary from local mosque times. We recommend verifying with your local Islamic center for important prayers.

EmanPal is not responsible for missed prayers due to inaccurate calculations, incorrect location data, or technical issues with notifications.

8. Third-Party Services

The App may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these third parties. Your use of third-party services is at your own risk.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Warranties that the App will be uninterrupted, error-free, or secure
Warranties regarding the accuracy of prayer times or Islamic content

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMANPAL SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, or consequential damages
Loss of data, profits, or business opportunities
Damages arising from your use or inability to use the App
Any spiritual or religious consequences of relying on the App

11. Indemnification

You agree to indemnify and hold harmless EmanPal, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Modifications to the Service

We reserve the right to:

Modify or discontinue the App or any feature at any time
Update these Terms with notice to users
Change pricing for premium features with advance notice

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EmanPal operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes may be submitted to binding arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
